Terms and Conditions – Survey Referrals

Countrywide Surveyors Limited, trading as Countrywide Surveying Services and Countrywide Home Surveys (‘Countrywide’, ‘CSS’ or we, us). Company number 1954031, registered Office: 2nd Floor, Boundary House, 4 County Place, Chelmsford, Essex, United Kingdom CM2 0RE.

These Terms and Conditions as amended by us from time to time apply to where you have contacted us for a quote, and we have referred you to a third party RICS registered surveying firm or surveying panel manager firm (‘Third Party Surveyor’)

Quotes

Where you request a quote for surveying services (‘Survey’) either via our website, by phone or by any other means, we will identify whether Countrywide can assist, or sometimes we will refer you to a Third Party Surveyor. Where we talk to you about appointment and delivery times, these are estimates and may change.

If you instruct Countrywide to carry out a Survey for you, the agreement between us will be governed by the terms and conditions communicated to you, and not these Terms and Conditions.

Where we refer you to a Third Party Surveyor, we act as an introducer on your behalf and the terms of this Terms and Conditions apply, and which relate only to the processing and management services in respect of the introduction.

Your payment for a Survey to be undertaken by a Third Party Surveyor is deemed to be acceptance of these Terms and Conditions:

  • You will receive terms and conditions from the Third Party Surveyor and you must enter into these directly with the Third Party Surveyor prior to the Survey taking place. You should read the information carefully to ensure that you are fully aware of the scope and limitations of the inspection and report you have requested.
  • Your rights relating to the Survey provided by a Third Party Surveyor are against that Third Party Surveyor. Countrywide does not complete the Survey and has no responsibility for and does not accept any liability in relation to the content, manner or quality of the Survey provided to you by the Third Party Surveyor.
  • If you experience any issues with your Survey, you should talk directly with the Third Party Surveyor and which will be dealt with in accordance with their complaints handling procedure.
  • We take a payment from you up-front on behalf of a Third Party Surveyor for the Survey.
  • We charge a management fee for each introduction made to a Third Party Surveyor, and which is deducted from the payment you make to us.
  • You are solely responsible for checking the suitability of the type of Survey and that a Third Party Surveyor will meet your requirements.
  • In no circumstances will we be responsible for the performance of, failure to perform, or the quality of any Services performed by a Third Party Surveyor to you.

Cancellation

We comply with the laws relating to cancellation of consumer contracts. By law you have 14 working days to cancel the Survey, starting on the day the contract is agreed, which means the date we take payment from you.

We will provide processing and management services to you, and the Third Party Surveyor may begin or deliver the Survey, earlier than this 14 working day period because reports are often required quickly and/or access to the property has been given earlier.

In accepting these Terms and Conditions, you agree to us and the Third Party Surveyor starting the Survey before the end of the 14 working day cancellation period and waive your right to cancel unless:

  • The property has not been inspected, the report has not been issued and verbal advice has not been provided by the Third Party Surveyor. A full refund can be provided.
  • The property has been inspected, however the report or verbal advice has not been provided. If this is the case a refund of 50% can be provided.
